Terms of Service

1. Acceptance of Terms

Welcome to BOOM ERP. These Terms of Service ("Terms") form an agreement between you and BOOM ERP, a product of Boom Media, headquartered in Al-Abdali, Amman, Jordan ("BOOM ERP", "we", "us"). They govern your access to and use of the BOOM ERP platform, websites, and services (collectively, the "Service"). By creating an account, starting a free trial, or subscribing, you agree to be bound by these Terms.

If you are using the Service on behalf of a company, you confirm that you have the authority to bind that company to these Terms.

2. The Service

BOOM ERP is an all-in-one business management platform that includes CRM and sales, call logging, a WhatsApp inbox, marketing automation by email and SMS (the Service does not publish to social media), projects, accounting and invoicing, inventory, HR and payroll, bookings, documents with e-signature, surveys and a password vault. We grant you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes during your active trial or subscription.

We continuously improve the Service and may add, modify, or remove features over time to enhance performance and security.

Some features rely on third-party services, including the WhatsApp Cloud API operated by Meta for the WhatsApp inbox, and email and SMS delivery providers for marketing campaigns. Your use of those features is also subject to the relevant third party's own terms and policies, and we are not responsible for their availability or for changes they make.

3. Accounts & Eligibility

To use the Service you must create an account and provide accurate, current information. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.
  • Ensuring that your team members use the Service in compliance with these Terms.

You must be at least 18 years old and legally able to enter into a binding contract to use the Service.

4. Free Trial

We offer a free trial of seven (7) days with full access to the Service so you can evaluate it before paying anything. Because we do not collect any payment details to start a trial, the trial never converts into a paid subscription automatically: at the end of the trial your access is suspended unless you choose to subscribe.

No credit card required. We never ask for your card or any payment details to start your free trial. You only pay if and when you decide to subscribe.

During the trial you may input real business data to test the platform. Data handling during and after the trial is described in our Privacy Policy.

5. Subscriptions & Billing

When you choose to subscribe, you agree to pay the fees for the plan you select and for any optional add-ons you purchase. Key points:

  • Each plan is a flat subscription that includes a defined set of applications and a maximum number of users; the fee does not change based on how many modules or user seats you actually activate.
  • Any optional add-ons you purchase are charged separately at the rates published on our Pricing page.
  • Subscriptions are sold on a monthly or an annual billing period, with annual billing offered at a discount. Your subscription renews automatically for the same billing period unless you cancel before the end of the current period, either from your account settings where that option is available or by notifying us at info@boom-erp.com.
  • We may change our prices for future billing periods; any change applies from your next renewal and we will tell you before it takes effect.
  • All fees are exclusive of applicable taxes unless stated otherwise.
Payments are non-refundable. Subscription fees, once paid, are not refundable. Please review our Refund Policy for full details.

6. Acceptable Use

You agree not to misuse the Service. In particular, you may not:

  • Use the Service for any unlawful, fraudulent, or abusive purpose.
  • Attempt to gain unauthorized access to the platform, other accounts, or our systems.
  • Resell, sublicense, or expose the Service to third parties without our written consent.
  • Upload malicious code or use the Service to send spam or unsolicited messages.

7. Your Data & Ownership

The business and customer data you enter into the Service belongs exclusively to you. The Service itself, including the software, source code, interfaces, documentation, and the BOOM ERP and Boom Media names and logos, remains our exclusive property, and nothing in these Terms transfers any ownership in it to you. We act only as a host and processor so the Service can run: we do not collect, access, read, use, or analyse the data you enter, and we never sell or share it. Our team reaches it only when you explicitly ask us for technical support, or where strictly necessary to operate, back up, or restore the Service. This is detailed in our Privacy Policy. If you send us suggestions or feedback about the Service, we may use them to improve it without any obligation to you.

You can export your data at any time while your account is active.

8. Termination & Suspension

You may cancel your subscription at any time; cancellation stops future renewals and takes effect at the end of the current billing period.

We may suspend or terminate accounts that violate these Terms, pose a security risk, or remain unpaid. Upon termination, data retention follows the timelines described in our Privacy Policy.

9. Disclaimers, Liability & Changes

The Service is provided "as is." To the maximum extent permitted by law, BOOM ERP is not liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue or data, arising from your use of the Service. Our total aggregate liability for all claims relating to the Service will not exceed the total subscription fees you actually paid us for the Service in the twelve (12) months before the claim arose. We do not warrant that the Service will be uninterrupted or error-free, and we are not responsible for downtime or failures caused by third-party networks, hosting providers or integrations.

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and, where appropriate, notify you. Continued use of the Service after changes means you accept the updated Terms.

10. Governing Law & Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or with your use of the Service, are governed by the laws of the Hashemite Kingdom of Jordan, without regard to conflict-of-law rules. The competent courts of Amman, Jordan shall have exclusive jurisdiction over any such dispute. Nothing in this clause prevents us from applying to any competent court for urgent or injunctive relief to protect our intellectual property or the security of the Service.
