Welcome to BOOM ERP. These Terms of Service ("Terms") govern your access to and use of the BOOM ERP platform, websites, and services (collectively, the "Service"). By creating an account, starting a free trial, or subscribing, you agree to be bound by these Terms.

If you are using the Service on behalf of a company, you confirm that you have the authority to bind that company to these Terms.

2. The Service

BOOM ERP is an all-in-one business management platform that includes CRM, sales, projects, accounting, HR, bookings, and related modules. We grant you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes during your active trial or subscription.

We continuously improve the Service and may add, modify, or remove features over time to enhance performance and security.

3. Accounts & Eligibility

To use the Service you must create an account and provide accurate, current information. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Ensuring that your team members use the Service in compliance with these Terms.

You must be at least 18 years old and legally able to enter into a binding contract to use the Service.

4. Free Trial

We offer a free trial so you can evaluate the Service fully before paying anything.

During the trial you may input real business data to test the platform. Data handling during and after the trial is described in our Privacy Policy.

5. Subscriptions & Billing

When you choose to subscribe, you agree to pay the fees for the plan and modules you select. Key points:

• You pay only for the modules and users you activate.
• Subscriptions renew automatically for the chosen billing period unless cancelled.
• All fees are exclusive of applicable taxes unless stated otherwise.

6. Acceptable Use

You agree not to misuse the Service. In particular, you may not:

• Use the Service for any unlawful, fraudulent, or abusive purpose.
• Attempt to gain unauthorized access to the platform, other accounts, or our systems.
• Resell, sublicense, or expose the Service to third parties without our written consent.
• Upload malicious code or use the Service to send spam or unsolicited messages.

7. Your Data & Ownership

The business and customer data you enter into the Service belongs exclusively to you. We act only as a processor to provide the Service, and we do not sell or share your business data, as detailed in our Privacy Policy.

You can export your data at any time while your account is active.

8. Termination & Suspension

You may cancel your subscription at any time; cancellation stops future renewals and takes effect at the end of the current billing period.

We may suspend or terminate accounts that violate these Terms, pose a security risk, or remain unpaid. Upon termination, data retention follows the timelines described in our Privacy Policy.

9. Disclaimers, Liability & Changes

The Service is provided "as is." To the maximum extent permitted by law, BOOM ERP is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and, where appropriate, notify you. Continued use of the Service after changes means you accept the updated Terms.
